Terms of Use
These Terms govern your use of nursel.ai. Please read them before you register or use any part of the platform.
01About these Terms
This website, nursel.ai, is operated by Nursel (Commercial Registration No. 1631096), a company registered in the Sultanate of Oman (“Nursel”, “we”, “us”).
These Terms govern your use of this website and any registration, assessment, or related functionality made available through it (the “Platform”). By using the Platform, you agree to these Terms. If you do not agree, please do not use the Platform.
These Terms apply to all users, including visitors, nursing professionals who register with us (“Candidates”), and healthcare institutions and partners (“Institutional Users”).
Our Privacy Notice also applies and explains how we handle personal data in accordance with the Oman Personal Data Protection Law (Royal Decree No. 6/2022).
Where you have signed a separate written agreement with Nursel, that agreement prevails over these Terms in respect of the services it covers.
02What Nursel does — and does not — provide
Nursel provides nursing workforce readiness assessment, preparation, and verification support services.
Nursel is not an employer and is not a recruitment agency acting on your behalf. Registering with us, completing an assessment, or achieving any readiness outcome:
- does not create an employment relationship with Nursel;
- is not an offer of employment or a guarantee of employment;
- does not guarantee that you will be presented to, selected by, or deployed with any healthcare institution;
- does not guarantee professional licensure, registration, or approval by any regulatory authority.
Hiring decisions are made solely by healthcare institutions. Licensing decisions are made solely by the relevant regulatory authorities. Nursel has no control over either.
03Eligibility
You may use the Platform only if you are at least 18 years old and legally able to enter into a binding agreement. If you register as a Candidate, you confirm that you are a qualified nursing professional and that all information and documents you provide are authentic, accurate, and complete. Submitting false, altered, or fraudulent information is grounds for immediate termination without refund.
04Your account
You are responsible for keeping your login details secure and for all activity under your account. You must not share your account with anyone or allow another person to complete an assessment on your behalf. Notify us immediately if you believe your account has been misused.
05Fees and refunds
Certain services on the Platform may require payment of a fee. Where a fee applies, the amount, what it covers, and the payment terms will be clearly displayed before you commit to payment. Fees are exclusive of value added tax and any other applicable tax, which will be added where required.
Fees payable by Institutional Users are governed by their own agreement with us.
Refunds. Your rights to a refund are those provided under the Consumer Protection Law of the Sultanate of Oman (Royal Decree No. 66/2014) and its implementing regulations, and nothing in these Terms limits those rights.
Subject to those rights, fees are payable for the assessment and readiness services we provide, not for any outcome, and are not refundable where:
- you do not attend, complete, or submit an assessment;
- you complete an assessment and are not placed in your preferred readiness band;
- you withdraw from the process after services have commenced;
- you are found ineligible following screening because information you provided was inaccurate or incomplete;
- you are not selected by any healthcare institution; or
- a regulatory authority does not grant licensure or registration.
Where we are unable to deliver a service you have paid for, for reasons within our control, we will provide a refund or a replacement service at your option.
06Assessment integrity
Our assessment content is confidential and secure. You must not copy, photograph, screenshot, record, transcribe, share, publish, or otherwise reproduce any assessment question, material, or answer, in whole or in part, by any means. You must not use or contribute to any question bank, recall list, or similar compilation derived from our content, and you must not use automated tools to access or extract content from the Platform.
Breach of this clause is a serious breach. We may void your results, withhold or revoke any readiness outcome, suspend or terminate your account without refund, inform affected institutions that your results have been voided, and take any further action available to us at law.
Assessment results and readiness outcomes are our professional opinion based on the information available and the methodology applied at the time. They are not a guarantee of clinical competence, licensure, or employability.
07Proctored sessions
Assessments are proctored . Your camera and microphone must be switched on and your face visible for the duration of the session. Automated checks run during the session to confirm your identity, that you are sitting the assessment alone, and that you are working unaided. These checks record your video and audio stream, your screen configuration, and activity in your browser session. What is recorded, how long it is retained, and who may access it is set out in our Privacy Notice , and you will be asked for your consent before the session opens.
You must sit the assessment alone, in a quiet private room.
You must not , during a session:
- allow any other person to be present or audible;
- use any second screen, mirroring, casting, or remote-access tool;
- use any AI assistant, chatbot, browser extension, search engine, notes, or reference material;
- capture any part of the assessment by screenshot, photograph, or recording.
Warnings. If a check identifies a problem with your setup — for example your camera is not visible, or a second display is connected — you will receive an on-screen warning and your timer will pause while you correct it. You may receive two warnings in a session. On a third, the session ends and no result is issued.
Returning after a lockout. If your session ends because of setup or environment problems, you may retake the assessment once at no additional cost , after a 48-hour interval and within 14 days. The retake is a complete new assessment with different questions; the ended session is disregarded in full. A further lockout will require a paid re-sit.
Conduct breaches. Where a check detects another person taking part, the use of an AI assistant or other prohibited aid, or an attempt to copy assessment content, the session ends immediately, your result is void, and no free retake is available. Clause 6 applies, including our right to inform institutions that your result has been voided.
Review by a person. No result is voided by an automated check alone. Every void and lockout is reviewed by a member of our team before it is confirmed. You may ask us to reconsider a decision by writing to info@nursel.ai within 7 days.
08Intellectual property
All intellectual property rights in the Platform and its content belong to Nursel or our licensors. This includes the Nursel name and logo, the Nursel Readiness Index™ (NRI™) and its framework, weightings, banding, and scoring methodology, the Nursel Medical Assessment System (NMAS) , all assessment items and materials, all reports, dashboards, and preparation content, and all software, designs, and databases.
We grant you a limited, revocable, non-transferable right to use the Platform for your own personal use as a Candidate, or your own internal business purposes as an Institutional User. No other rights are granted. You may not use our name, logo, or NRI™ without our prior written consent.
You keep ownership of the documents and information you submit. You grant us the right to store and process that material, and to share it with verification providers, regulatory authorities, and prospective institutions as needed to deliver the services and as described in our Privacy Notice .
We may use anonymised, aggregated data about Platform use for research, benchmarking, and service improvement, provided it does not identify you.
09Acceptable use
You must not use the Platform unlawfully or in any way that damages it, interferes with other users, introduces malicious code, attempts to gain unauthorised access to our systems, or attempts to bypass our security or assessment controls. You must not use the Platform to impersonate another person or to misrepresent your qualifications.
10Third parties
The Platform may rely on or link to third-party services, including verification providers, regulatory authorities, training providers, and payment processors. We are not responsible for their acts, omissions, delays, decisions, or content, and their own terms will apply to your dealings with them.
11Availability
We aim to keep the Platform available but provide it on an “as is” and “as available” basis. We do not guarantee uninterrupted or error-free access, and we may suspend, withdraw, or change any part of the Platform at any time.
12Our liability
Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded under Omani law, including under the Consumer Protection Law.
Subject to that, and to the fullest extent permitted by law, we are not liable for loss of employment or employment opportunity; failure or delay in obtaining licensure or registration; not being selected by any institution; loss of profit, revenue, business, or data; wasted expenditure including travel, examination, medical, visa, or agency costs; or any indirect or consequential loss.
Subject to the first paragraph of this clause, our total liability to you is limited to the total fees you have paid to us in the twelve months before the event giving rise to the claim. Where an Institutional User has a separate agreement with us, the liability provisions of that agreement apply instead.
13Suspension and termination
We may suspend or terminate your access to the Platform, without refund, if you breach these Terms, provide false information, compromise assessment security, or use the Platform unlawfully. You may stop using the Platform at any time. Clauses 6, 8, 12, and 14 continue to apply after termination.
14General
We may update these Terms from time to time. The version published on this page, identified by the “Last updated” date, is the version in force. Where changes materially affect registered users, we will notify you.
These Terms are issued in English. Any Arabic translation is provided for convenience; in the event of any discrepancy, the English version prevails unless Omani law requires otherwise.
These Terms are governed by the laws of the Sultanate of Oman, and the courts of Muscat have exclusive jurisdiction.
